Terms of Service

These terms govern your use of GrowBodi's website and mobile app (together, the "Service"), operated by Peter Nielsen ("GrowBodi," "we," "us"). By creating a GrowBodi account, you agree to these terms and to our Privacy Policy. If you don't agree, don't use the Service. Nothing in these terms limits your rights as a consumer under applicable Danish or EU law.

GrowBodi accounts are for parents or legal guardians, age 18 or older, setting up habits for their own child (ages 10–17). By creating an account you confirm you are that child's parent or legal guardian, or otherwise have authority to enter information about them, and that the information you enter is accurate to the best of your knowledge.

GrowBodi turns a parent-completed assessment into a GrowBodi Score, a set of priorities, a weekly habit plan, guided exercise/stretch suggestions, a daily habit tracker, and progress charts. It is a general wellness and habit-building tool for healthy children — not a diagnostic, therapeutic, or medical product.

GrowBodi is not a diagnostic tool, medical device, or substitute for professional medical, nutritional, or mental-health advice, and nothing in the app should be treated as such. If your assessment or check-in answers indicate a concern GrowBodi isn't built to handle — such as a possible eating-disorder concern, a relevant medical condition, an injury, or that your child is already under professional care — GrowBodi will not generate a plan and will direct you to seek guidance from a qualified professional instead. Always consult your child's doctor before making significant changes to their diet or activity level, especially if they have any underlying health condition.

GrowBodi may suggest physical activities, exercises, or stretches as part of a weekly plan. Physical activity carries an inherent risk of injury. You are responsible for assessing whether an activity is appropriate for your child's circumstances, and for their safety while performing it. Use this content at your own risk.

One account per family. You're responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at the contact address below if you suspect unauthorized access to your account.

GrowBodi offers a free tier and a paid "GrowBodi Plus" tier with additional detail. Paid subscriptions are billed on a recurring monthly or yearly basis through our payment processors (Stripe for web subscriptions, Google Play for Android subscriptions, the Apple App Store for iPhone subscriptions) until you cancel. Your subscription renews automatically at the then-current price unless you cancel before the renewal date. You can cancel at any time from Account settings (web), through Google Play (Android), or in your Apple ID subscription settings (iPhone); your access continues through the end of the period you've already paid for. We do not provide prorated refunds for unused portions of a billing period, except where required by Danish or EU consumer law.

You agree not to:

• Impersonate another person or misrepresent your relationship to a child.
• Submit information about a child you don't have the authority to act on behalf of.
• Attempt to disrupt, reverse-engineer, scrape, or gain unauthorized access to the Service or its underlying systems.
• Use the Service for any unlawful purpose.

GrowBodi and its content, features, and functionality (excluding the information you provide about your child) are owned by Peter Nielsen and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended personal, non-commercial purpose. You retain ownership of the information you submit about your child; you grant us a licence to use it solely to provide the Service as described in our Privacy Policy.

The Service relies on third-party providers — including Stripe, Google Play and the Apple App Store for payments and, optionally, NVIDIA for the coach's-note feature — whose own terms may apply to those parts of the experience. We are not responsible for the availability or content of third-party services.

You can stop using GrowBodi and request account deletion at any time from Account settings. We may suspend or terminate accounts that violate these terms, with notice where practical. Sections of these terms that by their nature should survive termination (intellectual property, disclaimers, limitation of liability) will survive.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SCORE, PRIORITY, OR PLAN IT GENERATES WILL BE ACCURATE OR SUITABLE FOR YOUR CHILD'S SPECIFIC CIRCUMSTANCES. THESE DISCLAIMERS DO NOT AFFECT YOUR STATUTORY RIGHTS AS A CONSUMER UNDER DANISH OR EU LAW.

TO THE FULLEST EXTENT PERMITTED BY DANISH AND EU LAW, PETER NIELSEN (OPERATING AS GROWBODI) IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) DKK 750. NOTHING IN THIS SECTION LIMITS LIABILITY FOR DEATH, PERSONAL INJURY, OR FRAUD CAUSED BY OUR NEGLIGENCE, OR ANY OTHER LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

You agree to indemnify and hold GrowBodi harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these terms or misuse of the Service.

If you have a complaint, please contact us first at support@growbodi.com so we can try to resolve it directly. If we cannot reach an agreement, disputes will be resolved by the Danish courts. As a consumer in the EU, you also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

These terms are governed by the laws of Denmark. If you are a consumer resident in another EU member state, you retain the benefit of any mandatory protective provisions of the law of your country of residence.

If any provision of these terms is found unenforceable, the rest remain in effect. These terms, together with the Privacy Policy, are the entire agreement between you and GrowBodi regarding the Service. We may assign these terms in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver of it.

We may update these terms as the product changes. For material changes, we will provide advance notice (for example, by email or an in-app notice) before they take effect. Continued use of the Service after an update means you accept the revised terms.
